Job Responsibility:

THIS JOB DESCRIPTION DOES NOT ATTEMPT TO LIST ALL OF THE DUTIES THAT ARE OR MAY BE PERFORMED IN THIS POSITION Primary Duties 1. Facilitates the damage recovery process to collect third party damages in a timely manner. 2. Evaluates and settles claims, applying technical knowledge and human relations skills to accomplish reasonable and prompt disposal of cases and to contribute to a decreased loss ratio. 3. Verifies and analyzes data used in settling claims to ensure that claims are valid and that settlements are made according to company practices and procedures. 4. Communicates with collection agencies and/or legal counsel representing the Company, with regard to evaluating witnesses, information and evidence gathering, and settlement expectations. 5. Documents and substantiates the third party liability to ensure restitution for damages. Monitors, tracks and submits delinquent claims to either collection agency or legal firm for restitution. 6. Visits client organization service centers quarterly to reiterate the third party damage claim process, and to inform of changes in policies, laws or best practices gained since last visit. 7. Maintains security access to various Internet websites (TESS, Utiliquest, Texas One-Call) to validate line locate requests, damage notifications, and locate company response to the same. 8. Evaluates, organizes, assembles subpoena responses and lawsuit discovery requests. 9. Escalates significant settlements to designated level of authority. 10. Monitors and reports collection progress to Manager, Damage Recovery and client organizations. 11. Authorize settlements in excess of the Damage Recovery Representative¿s level of authority. 12. Has knowledge of Collection/Damage recovery regulation and industry standards. Including but not limited too: a. State Tort Claims Act b. APWA (American Public Works Association) Guidelines c. Best Practices as defined by the CGA (Common Ground Alliance) d. State Excavation Safety Systems e. State Natural Resources Code f. State Utilities Codes g. State Health and Safety Codes MINIMUM REQUIREMENTS Educational/Experience Level Bachelor's degree in Business or a related field and three years progressively responsible professional experience in claims and litigation management; or High school education or equivalent and seven years progressively responsible professional experience in claims and litigation management. Claims adjusters license issued by the Texas Department of Insurance is preferred. Knowledge of OSHA Title 29 CFR, Title 49 CFR Section 192, Title 29 CFR Section 1926 is preferred. Communication Skills Requires strong written and communication skills to understand, interpret, and convey complex information to audiences with varies levels of expertise. Numeric Skills Requires the ability to apply research methods, and/or advanced statistical and/or accounting methods. Computer Skills Requires basic computer skills in order to utilize various software applications for developing documents, reports and graphics. Work Conditions Works in an office environment, subject to a 24-hour day call out. Requires occasionally performing activities including, but not limited to, bending, stooping, grasping, reaching, twisting, turning and/or lifting.
